Terms of business
What to expect from our inspection, how booking, payment and cancellation work, and what your rights are.
This is a translation. If the language versions differ, the Slovene version applies.
1. Who we are
The services are provided by Nikola Spasić s.p., Trg komandanta Staneta 8, 1000 Ljubljana, Slovenia (hereinafter PreveriAvto). We are not registered for VAT. You can reach us at info@preveriavto.si and +386 69 348 883. We don't see customers at the registered office, but you can send us post there.
2. What these terms cover
These terms apply to all our services: the pre-purchase inspection, the remote listing check, diagnostics with a second opinion, the check before the technical inspection, the EGR, AdBlue and DPF check, and any other service we agree on. The services and prices are described on the Prices page. Anything we agree differently in writing (including by email) takes precedence over these terms.
If you order as a business, the provisions that the law reserves for consumers do not apply: the right of withdrawal (section 9) and out-of-court resolution of consumer disputes (section 13).
3. What the inspection is and isn't
- The inspection is independent: we don't sell cars or parts, and we don't repair cars.
- The inspection is visual, electronic and non-invasive. We look the car over, read the data from its control units, measure paint thickness, test the battery and charging, use a thermal camera and a camera for hard-to-reach places and, if the seller allows it, take a test drive. We don't take parts apart or put the car on a lift.
- The inspection is not the official technical inspection (tehnični pregled). We are not an authorised technical inspection station or a court-appointed expert, and we don't issue official vehicle valuations.
- The report describes the car's condition at the time of the inspection, as far as it could be determined with the methods described, and contains our professional opinion. The report is not a guarantee and does not ensure that faults won't appear later.
- Some faults can't be found without taking parts apart, a longer drive or special equipment, and some only show up now and then. Anything we couldn't check at the inspection (for example because of the weather, access, the state of the car or limits set by the seller) is stated in the report.
- We compare the mileage stored in the control units with the documents and public records available to us. If the mileage has been changed everywhere, this can't always be detected. The report states what we checked and what we found.
- Rough estimates of repair costs are for information only. They are based on usual prices for parts and labour and are not a quote for a repair.
- The remote listing check is based on the listing, the VIN and publicly available sources. We don't see the car.
- The decision to buy, the price and the terms of the purchase are yours. We are not a party to your contract with the seller and are not responsible for the seller's statements or obligations.
4. Booking and the contract
- You send an enquiry using the form on the Booking page, by phone, by email, on WhatsApp or on Viber. An enquiry doesn't commit you to anything.
- We arrange a time with you and the seller. We then email you a booking confirmation with the service, the price, the time and a link to these terms.
- The contract is made when you accept the confirmation by replying to the email or with another written message.
- You can cancel a booking within 14 days (section 9). Because we usually carry out the inspection sooner, ask us to do so expressly in your enquiry or in your reply to the confirmation, for example: “Please do the inspection as soon as possible. I understand I can cancel within 14 days, but not once the inspection has been carried out.”
- We may decline or stop an inspection if it can't be done safely, if the seller doesn't allow it, or if you want a service we don't provide (for example repairs or changes to the car's software).
5. At the car
- We need the permission of the car's owner or seller to inspect it, including to connect a diagnostic device. We usually arrange the time with the seller ourselves; please make sure the seller knows the inspection is on your behalf.
- We only take a test drive with the seller's consent and in a car that is registered and insured. Normally the seller or you drive while we monitor the data. We drive the car ourselves only if the seller allows it.
- We carry out the inspection in a safe place where work on a vehicle is allowed.
- We use the diagnostic device to read data and run tests that don't change the car's settings. On a seller's car we don't clear fault codes or change settings. When diagnosing your own car, we do so only if you want us to and it's needed to find the cause of a fault.
- You can be present at the inspection or follow it by phone.
6. Prices and payment
- The price is the one published on the Prices page on the day we send you the booking confirmation, or the price stated in the confirmation.
- Prices are final. We are not registered for VAT, so VAT is not charged (Article 94(1) of the Slovenian VAT Act, ZDDV-1).
- Travel within Gorenjska and Ljubljana and the surrounding area is included. For other places we tell you the travel price in advance and state it in the confirmation.
- Diagnostics with a second opinion are charged by the time spent: €45 for the first hour, then €35 per hour, charged for each 15 minutes started. Before we start we tell you how long we expect it to take, and we don't go beyond that without your agreement.
- You can pay in cash or by card at the inspection, by bank transfer after receiving the invoice, or in advance on a pro forma invoice, as agreed. You receive the invoice by email. Invoices are due within 8 days.
7. Cancelling, rescheduling and wasted trips
- You can cancel or move the appointment free of charge until we set off for the car. Call or write to us.
- If we arrive at the agreed time but the inspection can't go ahead for reasons that aren't on our side (the car isn't there, the seller refuses the inspection, or cancels once we're already on our way), we charge only for the trip: €20, or the agreed travel price for places outside our area.
- If the seller stops the inspection once it has started, we send you what we found up to that point and charge a proportionate part of the price, never more than the full price.
- If we can't keep the appointment because of illness, a breakdown or another reason on our side, we let you know as soon as possible and agree a new time. In that case you pay nothing.
8. The report
- We email you the report with photos, usually the same day.
- The report is meant for you, for your decision about the purchase, and reflects the car's condition at the time of the inspection. You may show it to the seller, a garage or anyone else, but third parties cannot rely on it as our guarantee.
- The report may not be altered or published as our opinion of the car when it is sold later.
- We keep a copy of the report for five years (see the privacy policy) and can send it to you again on request.
9. Cancelling within 14 days (right of withdrawal)
If you are a consumer and made the contract at a distance (online, by email or by phone) or away from our business premises, you can cancel it (withdraw from the contract) within 14 days of the contract being made, without giving a reason.
- Tell us with a clear statement sent to info@preveriavto.si or by post to our address. You can use the cancellation form at the end of these terms, but you don't have to. You meet the deadline if you send your statement before it expires. We confirm receipt by email.
- If you withdraw, we refund all payments received within 14 days of the day we receive your statement, using the same payment method you used unless we agree otherwise. You pay nothing for the refund.
- If you asked us to start the service before the withdrawal period ended and then withdraw, you pay a proportionate part of the price for what we had already done. If we had already arrived at the car but not yet started the inspection, that is €20 for the trip.
- You lose the right of withdrawal once the service has been fully performed, if we started it at your express prior request and you confirmed that you understood you would lose the right once the service was performed.
10. If the service isn't as agreed
If the inspection or the report doesn't include what we agreed (for example, part of the inspection listed on the Prices page is missing), let us know as soon as possible. We put it right at no extra cost, for example by completing the inspection or the report. If we can't, we reduce the price accordingly or refund your payment. This does not limit your statutory rights.
11. Liability
- We carry out the inspection carefully and to professional standards, within the scope described in section 3.
- We are fully liable for damage we cause intentionally or through gross negligence.
- We are not liable for faults that could not be found with the methods in section 3 or did not show at the inspection, for faults and wear that arise after the inspection, for defects concealed by the seller or anyone else, for incorrect data in documents, records or control units, for any difference between our rough estimate and the actual cost of a repair, or for your decision to buy and your arrangements with the seller.
- If you think we missed something, tell us as soon as possible and, where possible, let us see the car before it is repaired, so we can work out together what happened.
- This section does not limit your statutory rights as a consumer.
12. Complaints
Send complaints to info@preveriavto.si or by post to Trg komandanta Staneta 8, 1000 Ljubljana, Slovenia. We acknowledge receipt within five working days and reply within 15 days of receiving the complaint. Complaints are handled confidentially.
13. Disputes
We aim to settle disputes amicably. If we reject a complaint, we email you our reasons and the details of the provider of out-of-court consumer dispute resolution.
We recognise the Slovenian Mediators' Association (Društvo mediatorjev Slovenije) as the provider of out-of-court resolution of our consumer disputes:
Društvo mediatorjev Slovenije
Poljanski nasip 2, 1000 Ljubljana
drustvo.mediatorjevslo@siol.net
031 591 744
slo-med.si
The procedure is free for consumers and voluntary. A settlement is reached only if both sides agree to it. If a dispute isn't settled, it is decided by the competent court in the Republic of Slovenia. Slovenian law applies.
14. Changes to these terms
We may change these terms. Each booking is governed by the terms published on the day we send you the booking confirmation. The date from which the terms apply is shown at the top of the page.
These terms are published in Slovene, English and Serbian. If the versions differ, the Slovene version applies.
